Debra Chigwell Limited supplies goods based on the following terms and conditions. By ordering from Debra Chigwell Limited or any associated online domains you agree to these terms and conditions.

 

1. Introduction

1.1. The meaning of some words used in these terms and conditions ‘we’, ‘us’ or ‘our’ is a reference to and trades under the name of Debra. ‘you’ or ‘your’ is a reference to the person whom we are supplying Goods and who is required to pay for the Goods we supply;

1.2. All text images photographs descriptions data illustrations graphics and other material (referred to as content) are protected and require our written permission to reproduce in whole or in part, even if used for the benefit of Debra Chigwell.

 

2. Acceptance of your order.

When you order on our website you are submitting to us a binding offer to purchase the goods in your shopping bag, and we will do our upmost to fulfil this order to the service levels you expect. Orders can be reviewed and amended before purchasing so you should ensure that you have checked the order thoroughly before submitting it to us. Please note it is not possible to amend an order once it has been submitted. You will receive an order confirmation from us via email which will be sent to the email address attached to your order placed. This order confirmation email acknowledges that we have received your order but does not constitute our acceptance of the order.

2.1 When you place an order online you give us authorisation to debit the credit, debit or other card or any other type of electronic payment you specify on your order for the amount of the order at the time we confirm the order acceptance.

2.2 acceptance of orders is at our discretion. When goods are dispatched you will receive an email confirmation only then will the contract be formed and the contract will relate only to those products detailed in the order confirmation, we will inform you if an item you have tried to order is out of stock.

2.3 we reserve the right not to accept your order for any reason whatsoever, including, but not limited to payment problems, product availability and product price or description error.

 

3 Suspension of Website

3.1 We reserve the right to suspend your use of the website at any time to perform essential maintenance, change details and to remove any inaccurate or an authorised material, and also, we may terminate your use of the website if you breach any of these terms

 

4. Cancellations.

4.1 we are unable to cancel orders after you have received your order confirmation email. If your order has already been sent out you may still cancel your order under the distance selling regulations. Refer to our returns policy for further guidance.

4.2 To cancel the contract you will need to send a letter to us. (Email is acceptable providing we confirm to you delivery of said email or letter) you can cancel the contract verbally you will need to then confirm the cancellation in writing (or email) See our Contact us page.

4.3 if you wish to return your order outside of the cancellation period please refer to our online refund policy.

 

5. Price of goods

5.1  We try our best to display accurate and up to date prices on our web site. But occasionally errors are made, we cannot state the definite price until we send you the order acceptance.

5.2  If the price of the goods is different at the time we are ready to send the order acceptance from the time you placed your order then two things can happen:

5.2.a    if the price is lower at the time we send the Order Acceptance then we will charge you the lower price and dispatch the goods; or

5.2.b    if the price is higher at the time we have sent the Order Acceptance then we will either cancel your order or contact you to ask if you wish to pay the higher price or to cancel your order. If the order is cancelled by us or you then if you have already made any payment(s), we will process a refund.

 

6. Availability and dispatch of Goods

6.1   Any times and dates given for dispatch of Goods (or the length of time that Goods will take to be delivered) are only best estimates. If we are unable to meet any stated dispatch or delivery dates, or times, we will make our best efforts to inform you as to the progress of your order. If the delay will be substantial or if the Goods will not be available at all for dispatch, we will offer you the option either to cancel your order and refund any payment(s) you have made or allow you to choose alternative Goods.

 

7. Delivery

7.1        We use third parties to deliver your goods, damage or loss prior to delivery of your goods will remain our responsibility. Please refer to our delivery policy for further guidance.

 

8. Limitation of liability

8.1  If the Goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing (Email is acceptable as written notice providing we confirm delivery of said email or letter) or by telephone or in person, at our contact address of the problem within 3 working days of the delivery of the Goods in question.

8.2   If you do not receive part of the goods or all of the goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you use reasonable efforts to notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the Goods.

8.2a  If you notify a problem to us under condition 8.1-8.2 our only obligation will be, at your option:

8.2b   To complete any delivery shortage or non-delivery or

8.2c  To replace or repair any goods that are damaged or defective; or

8.2d  To refund you the amount paid by you, for the goods in question up to the total of the invoice in whichever way Debra Chigwell decide at the time.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of third party compensation other than to refund to you the amount paid on invoice by you for the Goods in question.

8.3    You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase Goods from our site. The importation or exportation of certain of our Goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the Goods you purchase.

8.4   Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

 

9. Returns

If you wish to return any items, it is your responsibility to ensure their safe return. you must pay the cost of returning the items to us. If the return is due to a fault or error on our behalf, we will cover this cost. please refer to our returns policy for further returns guidance.

 9.1  Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

 

10. Contracts (Rights of Third Parties) Act 1999

For the purposes of the Contracts (Rights of Third Parties) Act 1999, this contract is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.

 

11. Law and jurisdiction

This contract shall be governed and construed by the law of England and you and we agree to submit to the jurisdiction of the courts of England and Wales.  We have endeavoured to form this policy to safeguard your purchase and ourselves from the acts of unscrupulous customers. Your legal consumer rights are not affected.
